A new class-action lawsuit is reigniting long-running concerns about Big Tech, user consent, and the quiet expansion of artificial intelligence inside everyday digital tools.

According to a January 6, 2026 report by NBC Chicago, Google has been sued over allegations that it enabled Gemini-powered “smart features” in Gmail without clear user consent—allowing AI systems to analyze private emails and attachments by default.

What the Lawsuit Alleges

The proposed class action, Thele v. Google LLC, filed in federal court in California in November 2025, claims Google quietly switched on advanced “Smart Features” around October 2025. These features, powered by Gemini, allegedly gained access to users’ full email histories, including sensitive financial, medical, and political information.

The core complaint is not that Google suddenly invented email scanning—spam filtering and smart replies have existed for years—but that AI-driven analysis was expanded without clear notice, while opting out requires navigating multiple settings menus. Plaintiffs argue this violates California’s Invasion of Privacy Act by relying on buried opt-out mechanisms instead of explicit consent.

Google Pushes Back

Google strongly disputes the claims. The company says the lawsuit is “misleading” and maintains that Gmail content is not used to train its large-scale Gemini AI models. According to Google, email data is processed only on a per-user basis to provide features like smart replies, inbox categorization, and scheduling suggestions—not to improve or retrain the underlying AI systems.

Some early reporting and viral social media posts in late 2025 suggested Gmail data was being fed directly into AI training pipelines, claims later walked back by several security outlets. Even so, critics argue that default-on scanning—AI-powered or not—raises serious transparency concerns.

Why This Matters

From a center-right perspective, this case highlights a recurring problem in modern tech governance: innovation moving faster than meaningful consent.

AI features may offer convenience, but when they are enabled by default across platforms used by billions, trust erodes quickly. Americans are increasingly skeptical of opaque data practices, especially when sensitive communications are involved. The controversy also underscores the difference between legal compliance and ethical clarity—companies can follow the letter of the policy while still losing public confidence.

Unlike Europe’s stricter opt-in privacy standards, U.S. users often face opt-out defaults, a regulatory gap that continues to favor corporate scale over individual control.

What Users Can Do Right Now

Gmail users concerned about privacy can disable these features manually:

  1. Open Gmail → Settings → “See all settings.”
  2. Scroll to “Smart features and personalization” and turn them off.
  3. Click “Manage Workspace smart features settings,” uncheck all options, and save.

Disabling these features may remove conveniences like smart replies or automatic categorization, but it limits AI access to personal communications.

The Bigger Picture

This lawsuit is still in its early stages, with class-action status pending and no rulings yet. But regardless of the outcome, the case reflects growing tension between AI-driven productivity and user autonomy.

For tech companies, the message is becoming clearer: transparency and consent are no longer optional side notes. For users, the lesson is less comfortable—digital convenience often comes with hidden tradeoffs, and the burden of protecting privacy still falls largely on the individual.
